What happened

- I saw this picture on July 23 at about 15:30,- said the author of the video. - A minor child was sitting on the driver’s lap while driving a Renault Scenic. The car was in traffic and moving along Plekhanov Street, after which it continued moving along Rokossovsky Avenue.

According to Evgeniy, the Renault driver, noticing that he was being filmed, stopped not far from the Salyut cinema.

- There was a child in the passenger seat who was transported without a child seat and without using seat belts. At the same time, the car window was completely open,- our reader is outraged.

He claims that he sent the video to the traffic police of the Leninsky district with a request to give a legal assessment of the actions of the Renault driver.

The head of the agitation and propaganda department of the Minsk traffic police, Sergei Zaranik, commented on the video to an Onliner.by correspondent.

- This fact is being investigated. This is a gross violation of traffic rules by the driver. It created a danger for both children in the car and other road users. In the event of an accident, children could be seriously injured - emphasized Sergey Zaranik.

He recalled that the traffic police requires strict compliance with the rules for transporting passengers and especially children.

The rules for the carriage of passengers are determined by Chapter 23 of the Traffic Regulations. In particular, it is indicated how the driver should transport children. Paragraph 178 states that transportation of children in a passenger car equipped with seat belts must be carried out using:

• child restraint devices appropriate for the weight and height of the child - up to the age of five years;
• child restraint devices corresponding to the weight and height of the child, other means (boosters, special seat cushions, additional seats) that allow you to safely fasten a child using seat belts provided for by the design of the vehicle - from five to twelve years of age.
• It is allowed to transport children under the age of twelve years without the use of the devices specified in part one of this paragraph if the child’s height exceeds 150 centimeters, as well as in a taxi car.
• It is prohibited to transport children in the front seat of a passenger car using child restraints appropriate for the weight and height of the child, the back of which is facing the windshield of the vehicle, if the front seat has an airbag, unless the front airbag mechanism is disabled.

In addition, there is clause 181.6, which clearly prohibits transporting children on the driver’s lap.

Other motorsport professionals are of the opinion that it is undesirable to let a child take the wheel too early - they need to learn to drive from the age of ten, or even fifteen. Then it is necessary to explain the rules of the road. “Firstly, it is at this age that a child understands what he is doing and can control his actions and be independently responsible for mistakes made while driving,” says young karting and racing driver Nikolai Zhuravlev. - Secondly, at three or four years old, a little person only understands which pedals need to be pressed and where to turn, but does not feel the real extreme driving - which means he does not feel danger. And finally, thirdly, only after ten years can children understand exactly whether they are really interested in driving a car, whether they need it or not.” Nikolai himself got behind the wheel at the age of eight, because his desire to drive and feel the speed on the road was very great, hence his great interest in cars. But he believes that this is, in general, too early.

The most dangerous thing in training a young driver may be that, upon reaching adolescence, he will “steal” his father’s car in order to show off in front of his friends, and this is already fraught with consequences.

There is also no consensus among the “aces” regarding teaching girls to drive a car. But the famous racer of the Guryev Vesava-cross team, Fedor Walter, has a different point of view and believes that “a girl should remain a girl, and she should be interested in dolls in childhood, because there is a possible risk of raising a little princess to a boy.”

• if the underage driver is drunk . In this case, the amount of payment to the state doubles and is at least 30,000 rubles. In this case, there is no threat of administrative arrest, since it is not applicable to children. This punishment is regulated by Article 12.8 of the Code of Administrative Offenses, paragraph 3. Additionally, the car owner may lose his license for one and a half to two years. In case of repeated violation, the certificate will be taken away for 3 years, and the fine will increase to 50 thousand.

If a minor child was driving drunk, but also took the car keys without asking, then he can be registered with a narcologist if the Commission on Minors Affairs decides so. Then it will be much more difficult for him to get a license, since a mark from a narcologist is also required by the medical commission.

Legal subtleties and additional penalties

The fact that the offender is a minor can be called a mitigating circumstance when considering a case of a committed offense. What happens if a minor is caught driving a car? Parents are immediately notified that a minor offender has been detained. In addition to a fine for violating traffic rules by a minor driver, he may face punishment under Art. 5.35 Code of Administrative Offenses of the Russian Federation.
