Which scooter does not require a license? Which scooters do not require a license - the procedure for obtaining a license. Location of the scooter on the roadway

Constant amendments and changes made to existing laws Russian Federation force many drivers to think about the question: is a scooter driver’s license needed in 2019 and are there penalties for not having a moped driver’s license at the time of an inspector’s stop. This issue is especially acute for minor owners of this type of transport.

A prerequisite for tightening control over scooter drivers was the law of November 5, 2013, aimed at strengthening the requirements for obtaining a driving license.

License to drive a scooter (moped) in 2019

Considering the newly introduced amendment to the Federal Decree “On Safety traffic"let's highlight the first point:

Therefore, starting from November 5, 2013, a mandatory driver’s license with category “M” was introduced for driving mopeds and scooters. At first, it seemed to everyone that from the moment the law was introduced, every owner of this type of transport would be forced to study and take exams at a driving school, but the rules for issuing certificates were actually adopted only a year later. After which, each scooter driver could undergo training and pass the state driving test in order to obtain a license to drive a scooter.

In addition, it was adopted traffic rules amendment, which read: if mopeds and various scooters are recognized as official vehicles (clause 1.2 of the traffic rules), then to drive them you must have a driver’s license (clause 2.1 of the traffic rules):

The above change was officially adopted in the rules on April 8 of the same 2014, which marked the beginning of the period when every scooter driver is required to carry a driver's license.

Category of driver's rights responsible for driving a moped or scooter

According to the law, the right to drive mopeds or scooters is confirmed by a license with the “M” category.

An exception for driving mopeds or scooters is the ability to travel on this vehicle with any other open category. For example, it is ideal for driving a scooter. This exclusive rule applies only to holders of Russian national type certificates:

If a driver once opened a “B” category abroad, he cannot ride a moped or scooter in Russia. An additional note prohibiting driving a moped (scooter), which is included in the certificate, may be a restriction () on the ability to drive a scooter due to a medical nature.

Features of using a tractor driver's license to operate a scooter

The rules state that it cannot be used as the main document for driving a scooter. For driving a scooter will do only a Russian national driving document.

Fine for missing license for a moped or scooter

Because the modern rules clearly regulate the punishment for the absence of a license to operate a scooter at the time of inspection; for violating the established driving regime, an administrative penalty is imposed on the driver.

The fine for missing a driver's license for a moped starts at 5,000 rubles. and reaches 15,000 rubles:

If such a violation is detected, the penalty may include removal from driving a two-wheeled vehicle. vehicle, as well as complete confiscation of transport until all circumstances are clarified. The detained vehicle (moped/scooter) will be transported to a designated impound parking. And only a person with a confirmed driver’s license can pick it up.

“We live in a village, three kilometers to the nearest store, to the bus stop public transport the same amount,” reader Vasily N. from the Kursk region contacted the DDD editors. I want to know when children will be able to legally use vehicles with some kind of engine, so that they can at least be sent to the store. I am sending you urgent questions. I hope that the traffic police representatives will give detailed answers to them in your “Car Showroom” section.

Employees of the State Traffic Safety Inspectorate of the Russian Ministry of Internal Affairs for the Kursk Region answer the reader's questions.

– Which mopeds/scooters/motorcycles are subject to mandatory registration with the State Traffic Safety Inspectorate, with what engine capacity – up to 49, up to 49.9, up to 50 cm/cc? What engine size is the current vehicle?

– According to Federal Law No. 196-FZ “On Road Safety”, as well as the Road Traffic Rules of the Russian Federation, “Vehicle” is a device intended for transporting people, goods or equipment installed on it along the roads.

Technical regulations Customs Union (TR CU 018/2011) “On the safety of wheeled vehicles”, approved by the Decision of the Customs Union Commission dated December 9, 2011 No. 877, gives a similar definition to the concept of “Vehicle” - a wheeled device of categories L, M, N, O, intended for the transport of people, goods or equipment installed on it. Category L – these are motor vehicles, M – vehicles that have at least four wheels and are used for transporting passengers, N – vehicles used for transporting goods – trucks and their chassis, category O – trailers (semi-trailers) for vehicles.

Thus, based on the analysis of the norms of current legislation, the concept of “vehicle” is not related to the value of engine volume.

At the same time, the Rules for registering motor vehicles and their trailers with the State Traffic Safety Inspectorate of the Ministry of Internal Affairs of the Russian Federation, approved by Order of the Ministry of Internal Affairs of Russia dated November 24, 2008 No. 1001 (registered with the Ministry of Justice of the Russian Federation on December 30, 2008 No. 13051) establish a uniform registration procedure throughout the entire territory of the Russian Federation in the State Traffic Safety Inspectorate of the Ministry of Internal Affairs of the Russian Federation for motor vehicles with engine displacement internal combustion more than 50 cubic centimeters or maximum power electric motor more than 4 kW, as well as a maximum design speed of more than 50 km/h and trailers for them intended for driving on roads common use and belonging to legal entities, citizens of the Russian Federation, foreign legal entities and citizens, stateless persons.

– Now there are scooters and bicycles with electric motors on batteries. Their speed is about 30 km/h, their range is 25-30 kilometers, are they vehicles? Do they need to be registered with the traffic police? At what age can you ride them? Do I need a driver's license for this and what category?

– The Technical Regulations classify the specified vehicles - mopeds, motorbikes, mokiks - into category L1, which also includes two-wheeled vehicles, the maximum design speed of which does not exceed 50 km/h, and characterized in the case of an internal combustion engine - engine displacement, not exceeding 50 cubic meters cm, in the case of an electric motor - rated maximum power in continuous load mode, not exceeding 4 kW.

The specified vehicles are not subject to registration with the State Traffic Inspectorate; to drive them, in accordance with the requirements of Part 1 of Article 25 of the Federal Law, you need a driver’s license of category “M” (mopeds and light quadricycles) or subcategory “B1” (tricycles and quadricycles) depending on the type of vehicle facilities.

The age limit for driving these vehicles is established by the Russian Traffic Regulations - 16 years.

– At what age and what category do you need to get a driver’s license to ride a moped/scooter/motorcycle on public roads?

Traffic regulations of the Russian Federation: “Moped” is a two- or three-wheeled mechanical vehicle, the maximum design speed of which does not exceed 50 km/h, having an internal combustion engine with a displacement not exceeding 50 cubic meters. cm, or an electric motor with a rated maximum power in continuous load mode of more than 0.25 kW and less than 4 kW. Quadricycles with similar technical characteristics are considered equal to mopeds.

According to the requirements of Part 1 of Article 25 of the Federal Law, to drive mopeds and scooters in the Russian Federation, you must have a special license to drive vehicles of category “M” (mopeds and quadricycles) or subcategory “B1” (tricycles and quadricycles), depending on the type of vehicle.

Traffic regulations of the Russian Federation: “Motorcycle” is a two-wheeled mechanical vehicle with or without a side trailer, the engine displacement of which (in the case of an internal combustion engine) exceeds 50 cubic meters. cm or the maximum design speed (with any engine) exceeds 50 km/h. Motorcycles are considered tricycles, as well as quadricycles with a motorcycle seat or motorcycle-type handlebars, having an unloaded weight not exceeding 400 kg (550 kg for vehicles intended for the transport of goods), excluding the weight of batteries (in the case of electric vehicles), and the maximum effective engine power not exceeding 15 kW.

To drive a motorcycle or scooter, you need a category A driver's license.

To drive a motorcycle with an internal combustion engine displacement not exceeding 125 cubic centimeters and a maximum power not exceeding 11 kilowatts - subcategory “A1”.

According to the requirements of Part 2 of Article 26 of the Federal Law, the right to drive vehicles is granted to:

– Which roads are not public roads? For example, asphalt streets in the private sector and alleys where there are no markings or signs - public roads?

– According to the provisions of the Federal Law of November 8, 2007 No. 257-FZ (as amended on February 15, 2016) “On highways and road activities in the Russian Federation and on amendments to certain legislative acts of the Russian Federation”, car roads Depending on the type of permitted use, they are divided into public and non-public roads.

Public roads include roads intended for the movement of vehicles of an unlimited number of people.

Non-public roads include roads that are owned, possessed or used by executive bodies of state power, local administrations (executive and administrative bodies municipalities), physical or legal entities and used by them exclusively to meet their own needs or for state or municipal needs.

Lists of public (non-public) roads of federal, regional or intermunicipal importance are approved accordingly by authorized federal executive authorities, the highest executive body of state power of a constituent entity of the Russian Federation. The list of public (non-public) use roads of regional or intermunicipal importance cannot include public (non-public) use roads federal significance and their areas. The list of roads of general (non-public) use of local importance may be approved by the local government body.

Thus, the presence or absence on the road road markings or road signs are not distinctive feature public roads. Such a road to equally can be both a public and non-public road. For example, the list of public roads of regional and intermunicipal importance falling under the jurisdiction of the Kursk region is determined by a decree of the administration of the Kursk region, and the list of local roads of the urban district "City of Kursk" is determined by a decree of the Kursk administration.

– The traffic rules say about driving on public roads, but on country roads and other non-public roads you can ride a moped without driver's license, from how old and with what engine size?

– The Russian Federation Traffic Regulations do not provide for the concept of “public road”.

Traffic regulations of the Russian Federation: “Road” is a strip of land or a surface of an artificial structure equipped or adapted and used for the movement of vehicles. The road includes one or more carriageways, as well as tram rails, sidewalks, roadsides and medians, if any.

“Road traffic” is a set of social relations that arise in the process of moving people and goods with or without vehicles within the boundaries of roads.

“Motor driven vehicle” is a vehicle driven by an engine. The term also applies to any tractors and self-propelled machines.

P. 2.1. Traffic rules of the Russian Federation - The driver of a motor vehicle is obliged to:

2.1.1. Carry with you and, upon request, hand over to police officers for inspection:

a driver's license or temporary permit to drive a vehicle of the appropriate category or subcategory;

registration documents for this vehicle (except for mopeds), and if there is a trailer, also for the trailer (except for trailers for mopeds).

Within the meaning of the above traffic rules depending on the type of motor vehicle, its driver is required to have and, if necessary, hand over to police officers only a driver’s license of category “M” or any other category or subcategory (clause 7 of article 25 of the Federal Law), regardless of the category of the road on which he is traveling . IN in this case mandatory and other traffic rules of the Russian Federation, applicable to drivers of the specified category of vehicles (Chapter 24 of the Traffic Regulations of the Russian Federation).

According to the requirements of Part 2 of Article 26 of the Federal Law, the right to drive vehicles of category “M” and subcategory “A1” is granted to persons over 16 years of age.

– What kind of moped, scooter and with what engine size can a child under 14, 16 and 18 years of age be purchased so that he can, without violating the rules, drive without a driver’s license in the private sector, country roads, public roads?

– In terms of the answers to the questions posed above, the Traffic Rules of the Russian Federation allow citizens who have reached the age of 16 to drive mopeds and scooters, subject to the mandatory possession of a driver’s license of the appropriate category (subcategory), regardless of the category of the road on which they travel.

Vehicles with an internal combustion engine displacement of 50 cubic meters. cm or less or a maximum electric motor power of less than 4 kW, as well as a maximum design speed of less than 50 km/h are not subject to registration with the State Traffic Inspectorate.

– What penalties are provided for non-compliance with all of the above and in what cases? There are so many changes in the laws on riding two-wheeled vehicles that your head is spinning! And whoever you ask – how many people, so many opinions.

– The actions of a moped or scooter driver who is driving without an appropriate driver’s license are subject to the sanction of Article 12.7 of the Code of Administrative Offenses of the Russian Federation.

Article 12.7 of the Code of Administrative Offenses of the Russian Federation. Driving a vehicle by a driver who does not have the right to drive a vehicle

1. Driving a vehicle by a driver who does not have the right to drive a vehicle (except for instructional driving) shall entail the imposition of an administrative fine in the amount of five to fifteen thousand rubles.

When committing offenses provided for in parts 1 and 2 of this article, the vehicle is detained, placed in specialized parking, and the person driving the vehicle is subject to removal from driving (Article 27.12 and Article 27.13 of the Code of Administrative Offenses of the Russian Federation).

“We live in a village, the nearest store is three kilometers away, the same distance to a public transport stop,” reader Vasily N. from the Kursk region contacted the editors of DDD. I want to know when children will be able to legally use vehicles with some kind of engine, so that they can at least be sent to the store.
By law Never!
Although any village is a separate state, where people live by their own rules. This was the case under the USSR and is still the case now. There is almost no traffic, all that is required of the driver is not to run over the neighbor’s chicken. This main law villages!
Our people from the villages understand perfectly well that a motorcycle in the village is like an iron horse. You don't need a license to own a horse! It's been thousands of years!
Only one thing is different! This horse is iron.
But horses are difficult now; it’s easier to buy a moped or motorcycle. In terms of a village, it is no different from a horse. Just like villagers don’t ride horses on the tracks and don’t go to the city. So on iron horses are not going to leave the village area.
This is how they live in villages!
The game of hide and seek with the traffic police begins! People understand this very well, it’s a kind of extra adrenaline. And no matter how hard they try to shout to be heard, they don’t hear them. After all, you want to live peacefully in the village, without being afraid to run 3 km to the store for some bread. But there is no public transport in the villages. Just like in the city. Not everyone wants to beat their legs 3 km. City and 500 meters do not go. They travel by minibus.
In the logic of the village, a horse is not subject to registration, and even more so unnecessary problems. The horse (iron) is not for problems with registration and the like. And sneak in for some bread, playing hide and seek with the traffic police.
This will always be the case!
Until those at the top understand this and make the necessary amendments to the laws. But something tells me nothing will change. So the game of hide and seek between the villagers and the traffic police will continue.
This is how we live and this is how we will continue to live!
And the villagers want to live in harmony with the traffic police, because if they run over the neighbor’s chicken, they themselves and the neighbor will come to an agreement.
Conclusion!
It's time to realize that a village is not a city. What is needed for safety in the city is not needed in the countryside.
They will understand, hide and seek will stop and there will be happiness for the villagers.
And on this moment, hide and seek and racing continue, it has been and will be forever! Which leads to hatred among villagers towards the traffic police.

If you understand that your need is charitable assistance, then pay attention to this article.
Those who, without your participation, may lose an exciting business have turned to you for help.
Many children, boys and girls, dream of becoming pilots on the track.
They go to classes where, under the guidance of an experienced trainer, they learn high-speed driving techniques.
Only constant exercises allow you to overtake correctly, build a trajectory and choose speed.
Winning on the track is based on good qualification. And, of course, a professional kart.
Children who participate in clubs are completely dependent on adults, because lack of money and broken spare parts do not allow them to participate in competitions.
How much pleasure and new sensations children experience when they get behind the wheel and start driving the car.
Maybe it is in such a circle that not only Russian champions grow up, but even future world champions in this sport?!
You can help the children's karting section, which is located in the city of Syzran. They are in a really bad situation right now. Everything rests on the enthusiasm of the leader: Sergei Krasnov.
Read my letter and look at the photos. Pay attention to the passion with which my students work.
They love this developmental sport and really want to continue learning.
I am asking you to help the karting section in the city of Syzran survive.
Previously, there were TWO young technician stations in the city, and each had a karting section. There was also karting at the Palace of Pioneers. Now there is not a single station in the city, and the circle in the Palace of Pioneers was also destroyed. They closed it, I can’t say enough, they just destroyed it!
We fought, wrote letters, and everywhere they had the same answer. About five years ago I went to the governor of the Samara region for a reception. He didn’t accept me, but my deputy accepted me.
After that, we were given premises where we were based. We have a lot of children who want to go karting, but very poor material conditions do not allow us to recruit children.
And most of the karts require repairs. This is the situation our circle is in.
We also turned to the mayor of the city of Syzran for help. This is the second year we have been waiting for help. We decided to turn to you via the Internet for help.

Deputies have long-standing plans to introduce subcategories for various vehicles, including the addition new category for mopeds, are gradually being implemented. New rules began to be implemented in 2013 and continue in 2015. However, is a scooter license really necessary? Let's try to answer this question.

On November 5, 2013, a law was passed requiring scooter owners to obtain and carry a driver's license. For a long time, it remained unclear what would be required to obtain a driver's license.

The end of the two-wheeled chaos?

Until April 2014, a scooter with an engine capacity of up to 50cc was not considered a mechanical vehicle, but now it belongs to the “M” category. The innovation had the greatest impact on teenagers, who had previously not been given any responsibility. Both 16-year-olds and 9-year-olds could be found driving a scooter with a volume of 50 cc or more! According to statistics, 15% of people under 18 years of age who, through their own fault, got into an accident while driving a moped, were intoxicated.

But how could they be banned from driving a scooter? No rights? there's nothing to lose. Punishments even for gross violations of traffic rules and road safety measures were rather formal in nature. Driving a vehicle with a 50cc engine without a license was not grounds for a fine, but rather on merit? riders only got caught during rough traffic violations, and only if the police caught up with the offender, since it was impossible to identify the scooter without a license plate. There was no need for documents for the scooter.

A drunk moped driver was fined 300 rubles. Interfering with road users, potentially creating emergency situations was punished by a fine of 500 rubles. Was it worth running a red light? 200 rubles, and more serious incidents involving slight and moderate harm to health through negligence were assessed? 1000-1500 rubles.

Many mopeds with 50cc engines can reach speeds of up to 90 km/h and above.

Introducing scooter rights was a necessary step.

Who can drive a scooter?

Drive a moped, scooter or ATV with an engine capacity of no more than 50 cubic meters, as well as maximum speed no more than 50 km/h can be driven by persons over 16 years of age who have passed a test on their knowledge of traffic rules. Citizens who already have driver's category(A-E), can safely drive a scooter without adding the letter “M” to their license. Driving a moped even with an engine of less than 50 cubic meters in the absence of any rights is fraught with an administrative penalty in the amount of 800 rubles.

“Self-preparation” for the traffic police exam was prohibited. The new driver's license will be finally introduced in 2015. In order to receive them, you must enroll in an accredited driving school, complete a training course and receive the appropriate certificate.

After the law was passed, honest owners of a 50 cc two-wheeler went to driving schools, but were deeply disappointed? There are no courses for an M-category license, and it is impossible to obtain a license for a scooter. This especially affected teenagers 16-17 years old, who could not obtain a driving license like their adult comrades. According to the latest information, the scooter driving course has already been drawn up, it remains to wait for government approval, which was expected by mid-2014. We can only hope that the issue will be finally resolved at the beginning of 2015.

Procedures at the traffic police

As mentioned above, those who have categories from “A” to “E” are not required to take the “M” category. So can I get any other category? and the right to drive a scooter appears automatically! However, you need to keep in mind that if you lose such rights while driving a scooter, you will not be able to drive a moped or a car.

A driving license for a scooter can be obtained in the same way as all others. It is necessary to complete a training course at a driving school and pass an internal exam, obtain a medical certificate, pay a state fee, collect a number of documents, successfully pass exams at the traffic police: theory, training, practice in the city.

The first thing you need to do is make sure that the driving school you choose is certified. The state has tightened the requirements for teacher qualifications, training courses and technical base. Vehicles in the driving school fleet must be in good condition, and the racing track must be equipped road signs, traffic lights and markings for completing elements. By 2015, the bar is expected to rise even further. It costs owners a lot of money to meet the new standards and obtain a license, so training fees are high. In 2015 price full course will cost on average 50% more than last year.

A medical commission must declare you physically and mentally healthy and fit to drive a vehicle. Need to?please? therapist, ophthalmologist, psychiatrist, narcologist, surgeon, otolaryngologist, and for women also a gynecologist. The medical facility may ask you to undergo testing for prohibited substances and alcohol. The certificate costs 500-2500 rubles.

From January 1, 2015, state duties will increase. The rule change turned out to be a New Year's surprise? from authorities who believe that the new rules will increase the level of responsibility of candidates when preparing for and taking exams. If today a paper driver's license costs 400 rubles, what about a plastic one? 800, from January 1, 2015, they will cost 2000 rubles! In addition, you will have to fork out money separately for each exam. Traffic rules and general theory? 1000 rubles, testing of driving skills on the site? 1500, city driving test? 2000 rubles. In fact, from 01/01/2015, exams will cost you 4,500 rubles. But that’s not all, add the cost of a plastic card, and in the end we get a bill of 6,500 rubles!

What papers should I submit? To assemble the package necessary documents To obtain a driver's license 2014-2015, you need: a receipt for payment of state fees, a certificate of completion of a training course at a driving school, medical certificate. certificate, identity card, application for a driver's license, certificate of registration at the place of residence or stay.

Both a powerful motorcycle and a weak one? 50cc scooter? this is transport increased danger. For safety you need: helmet, back protection, limb guards. You need to follow the rules of the road and not be distracted while driving, regardless of the size of your engine. For your own and others’ safety, you must undergo proper training, pass your license, and only then drive on public roads.

The times of “moped chaos” are irrevocably a thing of the past. Today it’s even difficult to imagine that just a year ago it was possible to enjoy driving a scooter not only without a driver’s license, but also in a state of slight intoxication, while violating the requirements of marking lines and not paying attention to traffic lights. Even if the traffic police managed to stop the owner of a moped with an engine capacity of up to 50 cc. cm, there was almost no possibility of bringing him to justice. But times have changed.

Introduction of rights to a scooter

* if the moped engine capacity exceeded 50 cubic meters. cm (according to passport);

* if it was necessary to carry a passenger over 7 years old.

In these cases, the inspectors required to present a driver's license with an open category “A”. This circumstance was actively used by teenagers who had the opportunity to ride fast mopeds on the streets, as well as by the moped manufacturers themselves, underestimating the rated power of their models to the required 49.9 cubic meters. cm.

After November 2014, the Federal Law regulating road safety issues underwent changes, and almost everyone began to need a license. In particular, the “M” subcategory was introduced for mopeds. The only good news was that owners of category “B”, as well as all other categories, will not need to register anything additional to drive a moped.

Where can I get a license for a scooter?

To obtain permission to drive a moped, you must contact a driving school, since self-study for the traffic police exam was also cancelled. You will need to stock up on a photograph and a medical certificate in the prescribed form. Due to the fact that the by-laws were not drawn up on time, not all regions currently have driving schools providing training in the “M” category - some need additional time to reorganize and develop new training programs. The learning process is not radically different from receiving category “A” or “B”, except that everything that is not related to mopeds and scooters has been removed from the tickets. Only persons over 16 years of age are allowed to take the exam.

Responsibility for lack of rights to a scooter

The law introduced administrative liability for drivers driving a scooter without a driver's license. You will have to pay a fine of 800 rubles. However, there are nuances. Firstly, the problem with the lack of by-laws regulating the issuance of licenses for new categories is known to traffic police officers. If the inspector’s claims consist only of the absence of a driver’s license, and the other requirements of the law are met (age over 14 years, wearing a safety helmet), then you can avoid liability by insisting that there was no way to obtain a license. In most cases, this argument will work, but sooner or later the gaps in the legislation will be eliminated and it will lose its relevance. It is also worth considering that a child under 14 years of age cannot be held administratively liable. However, in this case, the penalty may be directed at the teenager’s parents.

Which mopeds do not require a license?

There are still two-wheeled units with very impressive power and off-road characteristics, while not requiring a driver’s license or registration. These are mopeds designed for motocross, which from a legal point of view belong to the category of “sports equipment” and, strictly speaking, are not vehicles. They can cover distances regardless of the number of cubes and the presence of lighting devices, fulfilling the main condition - not to drive onto public roads.

Quick response: Any scooter requires a license. For low-power M, for powerful A.
